How to Compute the Number of Days of Presence in India for Tax Residency

Determining your residential status under Indian tax law starts with Section 6 of the Income‑tax Act, 1961, which deems you a resident if you spend 182 days or more in India during a financial year. While this clear benchmark governs whether your global income becomes taxable here, the Act itself offers no detailed instructions on how to count those days. Without a statutory rulebook, taxpayers and advisors alike turn to established international principles to ensure accuracy and consistency.

The OECD “Days of Physical Presence” Method

 Indian authorities and leading advisory firms adopt the OECD Model Tax Convention’s “days of physical presence”approach (Article 15). Under this method, any part of a calendar day spent in India counts as a full day toward the 182‑day threshold:

  • Day of arrival in India
  • Day of departure from India
  • Any portion of a day spent in India
  • Weekends (Saturdays & Sundays) spent in India
  • Public holidays spent in India

However, the following days are to be excluded for calculation of the 183 day period:

. Transit between two different points outside the state of activity if the individual is present in the state of activity for less than 24 hours.

. Holidays spent outside the state of activity. 

Applying These Rules in India

In practice, this approach is straightforward to implement. Simply tally every calendar date on which you set foot in India, then exclude brief transits and complete overseas stays. Maintaining an orderly file of boarding passes, entry‑exit stamps, and travel itineraries provides clear proof of presence or absence for each day. By following this internationally accepted framework and preserving precise records, you can confidently determine your Indian tax‑residency status and stay fully compliant with both domestic law and global best practices.
